DOG WAIVER

RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT

As a guest with a dog staying at Gravity Haus, you acknowledge and understand that there are risks associated with having a dog residing with you at the hotel. These risks include injuries suffered by the dog while at the hotel, whether attended to or left alone in the hotel room, and physical injuries or death suffered by other guests by actions of the dog. You agree:

• The only pets allowed at Gravity Haus are dogs.

• For your dog’s safety and the safety of our staff, the staff is not permitted to enter a room when the dog is not caged unless the owner is present and watches the dog. At all times the dog is left alone in the hotel room, you will place the door knob sign on the outside of the door alerting staff and other hotel guests that the dog has been left unattended in the room. Housekeeping services will NOT be performed in your hotel room if the dog is left unattended during the times housekeeping services are performed.

• You will keep your dog leashed at all times while outside the hotel room and while on the hotel property. The hotel does not have designated dog walk areas, so please be courteous and clean up after your dog.

• Dogs are not allowed in the following areas; any food and beverage serving spaces, hot tub or pool areas.

• To pay all additional cleaning and/or repairs costs necessitated by your dog’s stay, as required by the hotel, and all costs for any damage to person or property that the dog may cause as a result of being on the hotel premises. You authorize the hotel to charge your credit card for the necessitated costs, even if they are discovered following departure.

• You will be liable for any discounts or rebates that have to be given to guests should your dog be deemed to have caused a disturbance as determined by the hotel’s management team.

• The hotel reserves the right to refuse to accommodate and evict any dog that it determines in its sole opinion, may create a hazard or disturb the quiet enjoyment of its guests, employees or property.

In consideration of the hotel allowing you to house your dog at the hotel for the duration of your stay, you understand and voluntarily agree that you will be solely responsible for your dog and for any loss, damages, personal injuries, including death, sustained by you, your dog, Vail Resorts, Inc., any guest or invitee of the hotel arising from or related to your dog’s presence at the hotel. You will indemnify Vail Resorts, Inc., its employees, officers, directors, owners, affiliates, agents and assignees and each of their successors-in-interest (each, an “Indemnified Party”) from all property damages, injuries, losses and liabilities in any way arising from or related to your dogs presence and your acts or omissions during your stay at the hotel. Upon notice from an Indemnified Party claiming indemnify for a claim or threatened claim, Indemnified Party will assume defense of the claim and retain counsel. Any costs and expenses incurred by Indemnified Party as a result of the claim will be reimbursed by you.

You agree that any claims arising from the dog’s presence on the hotel premises will be GOVERNED BY COLORADO LAW and EXCLUSIVE JURISDICTION of any claim will be in the SUMMIT COUNTY COLORADO DISTRICT COURT or in the U.S. DISTRICT COURT FOR THE DISTRICT OF COLORADO. You agree to waive your rights to trial by jury in any legal action under this Agreement.

By signing this Agreement, you represent that you are at least 18 years of age. This Agreement is binding to the fullest extent of law. In any party of this Agreement is held invalid in a legal proceeding, then the rest of the Agreement will remain valid. This Agreement will be binding upon the successors, assignees, heirs, and legal representatives of the undersigned.

I HAVE CAREFULLY READ THE FOREGOING Dog WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT, I UNDERSTAND IT’S CONTENTS, AND I AGREE THAT I AM RELEASING CERTAIN LEGAL RIGHTS THAT I OTHERWISE MAY HAVE. I VOLUNTARILY SIGN THIS AGREEMENT WITHOUT RESERVATION.

DOG FEE IS $50.00 PER NIGHT PER DOG. TWO DOG MAXIMUM/120 LBS.
